1. Acceptance of Terms

By accessing or using Notifer ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to:

  • notifer.io website
  • app.notifer.io web application
  • Notifer mobile applications (iOS and Android)
  • All API endpoints and integrations

2. Description of Service

Notifer is an HTTP-based pub-sub notification service that allows you to:

  • Send notifications via simple HTTP requests
  • Subscribe to topics and receive real-time notifications
  • Manage notifications through web and mobile applications
  • Integrate notifications into your applications and scripts

The Service is provided "as is" with a focus on reliability and simplicity.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use the Service.

3.2 Account Creation

To use certain features, you must create an account with:

  • Valid email address
  • Username
  • Password (or OAuth via Google)

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access

3.4 Account Accuracy

You must provide accurate and complete information. Keep your account information up to date.

4. Subscription Plans

4.1 Free Plan

The Free plan includes:

  • Basic notification features
  • 100 messages per day
  • Public topics only
  • Community support

4.2 Paid Plans

Paid plans (Essentials, Team, Business) offer:

  • Higher message limits
  • Private topics
  • Priority support
  • Advanced features

4.3 Payment Terms

  • Payments processed via Stripe
  • Subscriptions renew automatically
  • Prices shown in EUR (or USD for non-EU customers)
  • You can cancel anytime

4.4 Refund Policy

  • 7-day money-back guarantee for first-time subscribers
  • Monthly subscriptions: prorated refund if cancelled within first 7 days
  • Annual subscriptions: full refund if cancelled within first 7 days
  • No refunds after 7 days, but you can cancel future renewals

4.5 Plan Changes

  • Upgrades: effective immediately, prorated charge
  • Downgrades: effective at next billing cycle
  • Features may be limited when downgrading

4.6 Price Changes

We reserve the right to change prices with:

  • 30 days advance notice
  • Existing subscriptions grandfathered at current price until renewal

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Notifer for:

  • ✅ DevOps alerts and monitoring
  • ✅ IoT and home automation notifications
  • ✅ Personal project notifications
  • ✅ Application integrations
  • ✅ Backup and maintenance alerts

5.2 Prohibited Uses

You may NOT use Notifer for:

  • ❌ Spam - unsolicited bulk messages
  • ❌ Harassment - threatening or abusive content
  • ❌ Illegal activity - anything that violates laws
  • ❌ Malware distribution - viruses, trojans, harmful code
  • ❌ Excessive load - intentional service degradation
  • ❌ Unauthorized access - hacking, scraping, or data mining
  • ❌ Impersonation - pretending to be someone else
  • ❌ Sensitive data - credit cards, passwords, health records in public topics

5.3 Rate Limits

Fair use rate limits apply:

  • Free plan: 100 messages/day per user
  • Paid plans: See pricing page for limits
  • API rate limits: Applied per subscription tier

Exceeding limits may result in temporary throttling or account suspension.

5.4 Content Responsibility

You are solely responsible for:

  • All content you publish to topics
  • Compliance with applicable laws
  • Obtaining necessary permissions from recipients

6. Intellectual Property

6.1 Your Content

You retain all rights to content you publish. By using the Service, you grant us a limited license to:

  • Store and transmit your messages
  • Display your content to authorized subscribers
  • Process your content to provide the Service

This license ends when you delete your content or account.

6.2 Our Service

Notifer and all related trademarks, logos, and service marks are owned by us. You may not use them without permission.

6.3 Open Source

Parts of Notifer may use open-source software. Applicable licenses are available upon request.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains:

  • What data we collect
  • How we use it
  • Your rights under GDPR

Key points:

  • Messages: Stored for 30 days, then automatically deleted
  • Account data: Kept until you delete your account
  • No selling data: We never sell your personal information
  • GDPR rights: Export, delete, or correct your data anytime

8. Service Availability

8.1 Best Effort

We strive for high availability but provide the Service on a "best effort" basis:

  • Target uptime: 99.5% for paid plans, 99% for free plan
  • No SLA guarantees (except Business plan)
  • Scheduled maintenance with advance notice

8.2 Service Changes

We may:

  • Modify features with notice
  • Deprecate old API versions (6 months notice)
  • Add new features
  • Improve performance and security

8.3 Service Interruptions

We are not liable for interruptions caused by:

  • Scheduled maintenance
  • Third-party failures (Expo, cloud providers)
  • Force majeure (natural disasters, war, etc.)
  • DDoS attacks or security incidents

8.4 Backups

We maintain backups but recommend:

  • Export important messages regularly
  • Don't rely on Notifer as sole data storage

9. Termination

9.1 By You

You may terminate your account anytime:

  • Settings → Account → Delete Account
  • All data permanently deleted within 90 days

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Abuse the Service (spam, excessive load)
  • Fail to pay (paid plans)
  • Engage in illegal activity

We'll provide notice when possible, except for severe violations.

9.3 Effect of Termination

Upon termination:

  • Access to Service immediately revoked
  • Paid subscriptions cancelled (no refund except as stated)
  • Data deleted per our retention policy
  • Topics you own become unavailable

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

  • Merchantability and fitness for purpose
  • Uninterrupted or error-free operation
  • Accuracy or reliability of content
  • Security against unauthorized access

Use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

  • ❌ Lost profits or revenue
  • ❌ Data loss or corruption
  • ❌ Indirect, incidental, or consequential damages
  • ❌ Service interruptions or downtime
  • ❌ Third-party actions (Expo, cloud providers)

Maximum liability: Total amount paid in past 12 months (or €100 for free users).

Exceptions: We remain liable for:

  • Gross negligence or willful misconduct
  • Personal injury or death
  • Violations that cannot be limited by law

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the Service
  • Content you publish
  • Violations of these Terms
  • Infringement of third-party rights

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Poland and the European Union.

13.2 Jurisdiction

Disputes will be resolved in courts of [Your City], Poland.

13.3 Informal Resolution

Before filing a lawsuit, contact us at support@notifer.io to resolve the issue informally.

13.4 EU Users

EU users may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

14. Changes to Terms

We may update these Terms with:

  • Notice: 30 days for material changes
  • Email notification to registered users
  • Continued use = acceptance after notice period

15. General Provisions

15.1 Entire Agreement

These Terms, Privacy Policy, and Pricing page constitute the entire agreement.

15.2 Severability

If any provision is invalid, the rest remains in effect.

15.3 No Waiver

Failure to enforce a right does not waive that right.

15.4 Assignment

We may assign these Terms. You may not assign without our consent.

15.5 Force Majeure

We are not liable for delays caused by events beyond our control.

15.6 Language

English version controls in case of translation conflicts.
